The Ndevu couple is facing charges of violating the Liquor Act, accused of either selling alcohol to underage individuals or pressuring employees to do so. On that fateful night, 12 girls and nine boys lost their lives within the tavern’s confines.

Nalo Mtizana, one of ten witnesses enlisted by the State, recounted to Magistrate Kevin von Bratt that the bouncer sealed the door and hastily departed. Shockingly, she alleged that Siyakhangela Ndevu witnessed patrons collapsing but failed to take any action.

According to Mtizana, the bouncer neglected to search her and three friends for weapons upon entry. She described the chaotic scene where the bouncer sprayed a substance, locking the door behind them. Mtizana managed to escape to an upstairs balcony to catch her breath and inform others about the unfolding tragedy.

The court did not receive information on how the locked door was eventually opened. Mtizana is the second witness out of three for the State, with survivor Mbasa Mpafi previously stating that a bouncer blocked fleeing patrons from exiting the locked door.

Nontsikelelo Nokhele, an administration clerk from the Eastern Cape Liquor Board and the third witness, testified that she interacted with Vuyokazi Ndevu in 2020 and 2022 during the liquor license granting process. Nokhele emphasized her instructions to Ndevu, emphasizing that no underage individuals should be allowed in the tavern, and security personnel should conduct thorough searches for weapons.

The liquor license was revoked, and the tavern was closed after an investigation by the Eastern Cape Liquor Board revealed that some of the deceased patrons were as young as 13 years old. The trial is set to continue as more evidence is presented.
